Report according to § 15 Sec. 2 EEG (transmission system operators) 2008

According to § 52 EEG, network operators and electricity supply companies are required to publish a report at their Internet sites concerning the determination of the data reported to them for the annual statement pursuant to §§ 45-49 EEG without delay after 30 September of a given year and to retain this until the end of the following year. The information and the report must make it possible for a qualified third party to be able to entirely reconstruct the balance of energy quantities and fee payments without any further information.

 

The transpower stromübertragungs gmbh satisfies its legal obligation pursuant to § 52 EEG with this report. In the following, the regulations of the EEG 2006 valid until 31 December, 2008 will be cited for the representation of the year 2008. Deviating from this, several dates will be named that are already based on the regulations of the EEG 2009. The latter are accordingly marked with *.

 

1. Basic principles

 

In the context of the EEG, the transpower stromübertragungs gmbh occupies both the role of the network operator obligated to purchase in the sense of § 4, (1) or 5 EEG for indirectly and directly connected EEG plants and the role of the responsible transmission system operator (TSO) according to regulations. As the network operator obligated to purchase, the transpower stromübertragungs gmbh purchases power from plants that directly and indirectly feed into the network and that fall under the jurisdiction of the EEG and remunerates these pursuant to §§ 6 - 11 EEG. As the responsible transmission system operator according to regulations, the transpower stromübertragungs gmbh purchases EEG energy from downstream network operators in the control area and remunerates these pursuant to the EEG. The transpower stromübertragungs gmbh also carries out the horizontal equalisation of load with the three other transmission system operators. The transpower stromübertragungs gmbh subsequently supplies EEG energy to the suppliers of end customers.

 

2. Determination of the EEG power quantities indirectly or directly fed into the transmission system

 

The data necessary for the fee payments and the nationwide equalisation according to § 14a, (1) and 2 EEG are requested from the EEG plants operators whose plants are indirectly or directly connected to the system of the transpower stromübertragungs gmbh, insofar as these are not already available to the transpower stromübertragungs gmbh. The information is also transparently visible for each plants at the homepage of the transpower stromübertragungs gmbh pursuant to § 15, Par. 2 EEG in section 2, link to EEG feed-in. As a system operator, the E.ON Netz GmbH is to be selected for the year 2008.

 

3. Determination of the power quantities fed and remunerated in the control area

 

The distribution system operators (DSO) were requested on 27 February, 2009 to provide the data specified (distribution system operator report) in § 14a, (2) EEG prior to 31 May* and to also have this certified prior to 31 May* by an auditing company or chartered accountant (distribution system operator attestation 2008). In the case of feeds-in with feed feed-in of less than a minimum threshold of 20,000 Euros following deduction of the avoided grid use charge mutually agreed upon between the relevant distribution system operators and the transpower stromübertragungs gmbh, an attestation is dispensed with and other appropriate documentation (e.g. internal report of the business management) provided by the distribution system operators.

 

The recording of data for the year 2008 until 31 May, 2008 hereby took place through electronic channels via the EEG/KWK portal of the transpower stromübertragungs gmbh with automated and manual testing of plausibility.

 

After 31 May, the submitted certifications from auditing companies or chartered accountants were recorded and a comparison made with the existing annual reports of the distribution system operators and open points clarified with the distribution system operators through bilateral contact.
The reports / attestations contain the EEG power quantities fed into the respective network separated according to fee classes / energy carriers and the affiliated fee. In addition to this, the avoided grid use charge deducted by the distribution system operators pursuant to § 18, Par. 2 Electricity Network Fee Regulation (StromNEV) is reported and attested.
In addition to the aggregate values, the distribution system operators also provided system-specific data. This involves both plant master data and the related power quantities, fee payments and avoided grid use charge.
The claim for the equalisation of load owed to the distribution system operators is determined through the summation of the certified data.
The information of the network operators provided in the context of reports and attestations are also visible pursuant to transparently § 15, (2) EEG in section 2, link to EEG feed.

 

4. Determination of the power quantities delivered to end consumers in the control area

 

On the basis of the existing contact data from electricity supply companies originating from the EEG processing throughout the period, and taking into account the company master data provided by the Bundesnetzagentur concerning the electricity supply companies known to it, the transpower stromübertragungs gmbh has determined all electricity supply companies in the control area that come into question for the purchase of EEG energy.
The electricity supply companies (ESC) were requested on 11 March, 2009 to provide the data specified in § 14a, (5) EEG prior to 31 May through the EEG/KWK-G Portal (ESC annual report 2008) and to also have this certified prior to 31 May by an auditing company or chartered accountant (electricity supply company attestation 2008). In the case of supply to end consumer sales of less than 5 GWh, other suitable documentation (e.g. internal report of the business management) was accepted.

 

After 31 May, the submitted ESC attestations or self- confirmations were recorded and a comparison made with the existing annual reports of the electricity supply companies and open points clarified with the electricity supply companies through bilateral contact.
The certified end consumption quantities and the customer information pursuant to § 16 EEG form the foundation for the obligation to purchase of the ESC pursuant to § 14, (3) EEG. For the privileged power quantities, the obligation to purchase results as a product of the reduced share established by the respective decision of the Federal Department of Economics and Export Control (BAFA) and the privileged power quantity. For non-privileged end consumption, the EEG energy quantity is a product of the end consumption and the uniform national EEG share (see section 5).
In the control area of the transpower stromübertragungs gmbh, the end consumption in the period considered amounted to 147,417,752 MWh. Of this, 15,646,611 MWh were privileged in the sense of § 16 EEG. Affiliated with the privileged end consumption is an EEG power quantity of 105,236 MWh to be deducted.

 

5. Determination of the nationwide EEG invoice

 

The prerequisite for the determination of the EEG share and the EEG average fee is the nationwide merging of the invoicing data. To this purpose, the four transmission system operators aggregate the fed in power quantities, the fees paid and the deducted avoided grid use charges pursuant to § 5, Par. 2 EEG in connection with § 18 Par. 2 Electricity Grid Use Charges Regulation (StromNEV) for the Bundesverband der Energie- und Wasserwirtschaft e.V. (BDEW) (Federal Association for Energy and Water Supply and Distribution). The end consumption, the privileged quantities pursuant to § 16 EEG and the EEG power quantities to be assigned to these are also summarised.

 

The nationwide result was a delivery volume of 8,786,690,893.13 Euro minus avoided grid use charges of 298,729,745.70 Euro plus the corrections from the previous year of 69,669,436.71 Euro. The EEG power quantity amounted to 71,711,739 MWh plus the corrections from the previous year of 563,851 MWh. The average fee resulting from this quotient is 12.253 ct/kWh.

 

In order to determine the EEG share, the EEG power of 515,951 MWh assigned to the privileged end consumption (77,990,547 MWh) is to be deducted from the total EEG power quantity (71,711,739 MWh). The EEG share is a quotient of the remaining EEG power quantity (71,195,788 MWh) and the non-privileged end consumption (415,515,244 MWh) of 17.134 %.

 

The EEG share determined in this way and the EEG average fee are applied for invoicing the ESC in the sense of § 14a, (4) EEG.
