The German Combined Heat and Power Act (KWK-G)
The German Combined Heat and Power Act (KWK) of 25th October 2008 came into force on 1st January 2009. It involves a far-reaching change to the act on maintaining, modernising and extending combined heat and power of 19th March 2002 (KWK-G 2002). The two main changes compared to KWK-G 2002 are:
- According to KWK-G 2002, only the KWK share of the quantity of electricity produced (KWK electricity) was subsidised, which was fed into the grid at all voltage levels for general supply. As of 1st January 2009, KWK electricity will also be subsidised that is not used for general supply in a grid, rather is fed into non-public grids or is used for self-supply.
- Furthermore, subsidies for new heat networks or expanding heat networks has been included in the act.
As of 2009, the subsidies is a maximum of 750 million euro annually including a maximum of 150 million euro for the subsidies of new heat networks or expanding heat networks (cap).
The given information (see links and downloads) shall ensure a standardised, non-legally binding mode of implementation with regard to the processing and implementation of the act - if possible also with the inclusion of official materials - by the transmission system operator, which is transpower stromübertragungs gmbh here.
For the smooth implementation of the KWK-G [Heat and Power Cogeneration Act] in a consistent manner throughout the country, a common understanding of the statutory prescriptions on the part of all players involved is essential. The BDEW's [German Energy and Water Association] current Umsetzungshilfe [Guide to Implementation of the KWK-G] should contribute to this. You can download them as a pdf file from http://www.bdew.de/ under the heading Energie => Energienetze und Regulierung => EEG/KWK-G => KWK-G-Umsetzungshilfen [Energy => Energy networks and regulation => EEG/KWK-G (Renewable Energy / Heat and Power Cogeneration Act) => KWK-G (Heat and Power Cogeneration Act) implementation aids] or use the direct link at Bedingungen für die 1. This has been developed on the basis of earlier information issued by the association, in particular the Verfahrensbeschreibung zum KWK-G 2002 des Verbands der Netzbetreiber - VDN - e.V. [Procedural Description in relation to KWK-G 2002 of the Association of German Network Operators (VDN)] with the VDEW [German Electricity Association], the accumulated experience in recent years of implementation of the act on the part of companies that are members of BDEW, and legal pronouncements in connection with BDEW project work. The indications given by the Guide to Implementation do not permit the derivation of any claims at law.
